Accused Serial Rapist Marc Winner To Appear in Court Next On Sep. 15

COOK COUNTY CRIMINAL COURTHOUSE — Accused serial rapist Marc Winner is slated to appear in court again on Sep. 15.

Winner, 45, is charged with raping four women from 2009 to 2015. Three of the alleged victims were customers or employees at Winner's Soleil Tanning Salon, 1018 W. Madison St., which was shuttered by the city in May. Prosecutors claim the fourth woman was raped by Winner inside his mother's Edgewater home.

Last month, Winner's defense attorney, Steven J. Weinberg, filed a motion seeking to dismiss one of the cases: an alleged 2009 attack that involved a former employee.

Prosecutors were expected to file a response Wednesday, but during a brief hearing before Cook County Judge Carol M. Howard, Assistant State's Attorney Mikki Miller asked the judge for more time to prepare her remarks.

Miller now has until Aug. 31, the judge ruled, while Weinberg is expected to file a response to Miller's response by Sept. 14. Winner will be back in court Sept. 15, when Howard will announce the date Weinberg and Miller can argue the issue.

Prosecutors initially filed charges in the case in question in 2013, four years after the 2009 attack. Judge Adam Bourgeois Jr. during a preliminary hearing said there was no probable cause to pursue criminal charges — and the case was dropped.

Prosecutors once more filed charges in the case in April through a grand-jury indictment.

That same week, Winner was charged in the third of four pending rape cases and held without bail after Judge Bourgeois dubbed Winner "a danger." But earlier this month, Judge Howard set bail for Winner, and he has been free on bond since Aug. 9. He refused to speak with media outside Cook County Jail, 2700 S. California Ave., after his release.

Weinberg has previously argued that prosecutors are piling on old cases against Winner and infringing on his constitutional right to a speedy trial.

It's not clear why there was a four-year lag in filing charges after the 2009 rape, or why prosecutors waited three years to refile charges after the 2013 dismissal. Prosecutors did not respond to multiple requests for comment.

Though Winner is only charged in four cases, prosecutors allege he has raped at least nine women. Assistant State's Attorney Mikki Miller said she has identified five additional possible victims, but the attacks happened too long ago for prosecutors to file criminal charges.
