After Police Shoot Man, Woman Charged with Kicking Shell Casings on Scene

COOK COUNTY CRIMINAL COURTHOUSE — An Englewood man who was shot by police early Wednesday was held on $1 million bail Friday after prosecutors charged him with aggravated battery and unlawful use of a weapon.

A Far South Side woman was also charged in the incident after police said she disturbed the crime scene by kicking shell casings. Prosecutors allege Idella Hamilton, 26, resisted arrest — shoving and hitting the officers.

She was charged with aggravated battery to a peace officer and obstructing or destroying evidence. On Friday, Cook County Judge Adam Bourgeois Jr. ordered her held in lieu of $75,000 bail.

"We do not fight the police in Chicago," Bourgeois said during a bond hearing.

Kenneth Lewis, 23, who was shot by police three times, did not appear in court. Police testified he was still in the hospital in serious condition.

Assistant State's Attorney Erin Antonietti told the court that Lewis appeared before Judge Bourgeois just six days earlier, on July 18, on a DUI charge. Bourgeois set bail at $50,000, Antonietti said, and someone posted bond for Lewis on July 20, two days before the police-involved shooting.

The shooting took place about 1:40 a.m. Wednesday in Englewood.

Police in a statement said officers were on patrol when they spotted a "large, unruly crowd" in the 5600 block of South Morgan Street. Lewis allegedly tried to run away, while holding his hand at his side. Officers told Lewis to stop and began to chase him when he didn't, the statement said.

At that point, Lewis pulled a gun from his waistband and pointed it toward the officers, Antonietti said. Police responded by firing multiple rounds, striking Lewis three times.

According to prosecutors, an angry crowd of about 30 people gathered around police.

While the officers were distracted, Lewis, who was injured and bleeding, tried to run away, Antonietti said. He made it to an alley in the 5600 block of South Sangamon Street, where police arrested him at 1:44 a.m., according to an arrest report.

Officers recovered a .40 caliber gun, loaded with one live round and additional rounds in the magazine, police and prosecutors said.

A short while later, officers spotted Hamilton kicking three or four shell casings in the street, Antonietti said. This was before an evidence technician was able to document the unaltered crime scene, she added.

When police tried to arrest Hamilton about 1:43 a.m. in the 5600 block of South Morgan Street, she resisted, according to the arrest report.

Hamilton, of the 200 block of East 132nd Street, was charged with aggravated battery to a peace officer and obstructing or destroying evidence.

Lewis, meanwhile, was taken to a local hospital. Lewis, of the 5500 block of South Peoria Street, was charged with unlawful use of a weapon by a felon and two counts of aggravated assault to a peace officer.

Lewis' mugshot was not available.
