Two Men Charged After Off-Duty Officer Shoots One in Hermosa

CHICAGO — Two men were charged after one of them pointed a gun at an off-duty police officer outside a Hermosa restaurant Saturday and was shot as a result, cops said.

Rene Bustamante, 20, of the 3900 block of West Barry Avenue, was charged with felony aggravated assault to an officer with a firearm. Daniel Delgado, 28, of the 300 block of North Lawndale Avenue, was charged with felony aggravated assault to a police officer with a weapon. 

Police initially said an off-duty officer saw two men creating a "disturbance" inside a restaurant about 9 p.m. Saturday in the 4300 block of West Fullerton Avenue.

After the officer told the unruly men he was a cop and escorted the them out of the building, one of the men went to a car, grabbed a gun and pointed it at the officer, according to the police statement.

The cop then fired his gun, striking one of the suspects in his leg, according to police. He was treated at an area hospital. The other man was not injured, police said.

Police said bail will be set for Bustamante and Delgado on Monday.
