Man Points Loaded Revolver at Police, Officers Leave Guns Holstered: Court

COOK COUNTY CRIMINAL COURTHOUSE — An East Garfield Park man pointed a loaded gun at police early Sunday — but the officers never drew their own weapons, prosecutors said.

Instead, two police officers from the Ogden district jumped a fence and wrestled the revolver away from 39-year-old Bernal Eubanks, Assistant State's Attorney Erin Antonietti said during a bond hearing Monday.

Eubanks had been standing inside a locked gate at his ex-girlfriend's home about 4 a.m. Sunday and refusing to leave, according to police and prosecutors.

He is currently on probation for a February 2015 domestic-battery conviction.

Police were called to the home in the 1900 block of South Trumbull Avenue to address a burglary-in-progress call, according to an arrest report. They were told to look out for a suspect in a green shirt and green camouflage pants, the report said.

When officers arrived, they spotted Eubanks, who matched the description, and repeatedly asked him to leave the gated area, prosecutors said.

Eubanks allegedly refused, so one of the officers jumped the fence. As he did so, Eubanks reached down and picked up a silver .38 caliber Smith and Wesson revolver, loaded with five live rounds, court records show.

The officer grabbed Eubanks and tried to wrestle the gun away from him, Antonietti said. As the two struggled, the second officer jumped the fence, the arrest report said, and Eubanks pointed the gun at him.

Both officers tried to grab the gun, prosecutors said, and Eubanks pointed the loaded weapon at the officers at least one more time before they were able to grab it.

According to Antonietti, Eubanks does not have a valid FOID card or conceal-and-carry license.

Eubanks, of the 3300 block of West Congress Parkway, was charged with unlawful use of a weapon by a felon, criminal trespassing and two counts of aggravated assault of a peace officer.

Cook County Judge Peggy Chiampas on Monday ordered Eubanks held in lieu of $750,000 bail.

Antonietti said Eubanks has eight prior felony convictions, including possession of a stolen motor vehicle, unlawful use of a weapon by a felon and several drug charges.
