South Shore Dad Killed in Payback Robbery, Prosecutors Say

CHICAGO — A South Shore man was held without bail Thursday after prosecutors said he fatally shot a 26-year-old dad during a payback robbery.

Christopher Garcia, 26, of the 8000 block of South Shore Drive, is facing murder and attempted armed robbery charges in the Tuesday slaying of Derrick Mcintyre, police said.

Prosecutors said Garcia and several accomplices confronted Mcintyre outside his apartment in the 7800 block of South Coles Avenue around 10 a.m. Tuesday.

The group told Mcintyre to open his front door so they could rob him, but he refused because his pregnant girlfriend and baby were inside, Assistant State's Attorney Barry Quinn said in court Thursday.

Mcintyre's girlfriend heard the commotion, called 911 and ran out the back door to a neighbor's apartment, Quinn said. As she arrived, she heard several gunshots.

Police responding to the 911 call saw Garcia running south on Coles Avenue and found him hiding under a tarp a block and a half away, prosecutors said.

Garcia told police he and his friends tried to rob Mcintyre to get back property that Mcintyre had ripped off from one of Garcia's friends, Quinn said.

Mcintyre was shot seven times in his hand, wrist, torso, back and chest, prosecutors said. He was pronounced dead at Advocate Christ Medical Center at 10:44 a.m., according to the Cook County Medical Examiner's Office.

Police found gunshot residue on Garcia's hand, prosecutors said.

Garcia is on parole for a 2014 drug case. He was sentenced to one year in prison on Oct. 17 and released on Oct. 20. He had been credited with 183 days served while awaiting trial. His parole discharge date is Oct. 20, 2015.

Cook County Judge Peggy Chiampas ordered Garcia held without bail.
