CHICAGO — A third man has been charged in the murder of 73-year-old Elmer Brown, a retired police sergeant who was fatally shot during a home invasion on March 10.

Nicholas Heisler, 20, of Indiana, was charged with murder and home invasion when he was caught this week.

Last week, Jeremy Mendez, 16, was also charged in Brown's death.

Mendez believed there was a safe full of money in Brown's East Side home in the 11500 block of South Avenue G, so Mendez, 18-year-old Jesse Kazmierski and Heisler cooked up a plan to rob the home, prosecutors said.

Brown and his 72-year-old wife were at home watching TV around 11:40 p.m. March 10 when Mendez and one of his accomplices knocked on their front door, Cook County Assistant State's Attorney Jamie Santini said.

When Mrs. Brown opened the door, the men forced their way into the house. While the group ransacked the home, she heard a single gunshot and saw her husband lying on the floor. He was shot in the face and neck, prosecutors said.

Brown, who retired after 38 years on the police force, was taken to Advocate Christ Medical Center where he underwent emergency surgery. Nearly two weeks later, Brown was pronounced dead at the hospital, according to the Cook County Medical Examiner's Office.

Heisler is expected to appear in bond court Thursday.
