Judge Lets Michael Grimm Delay Jail Time for Surgery

STATEN ISLAND — Michael Grimm has been allowed to delay his jail sentence so he can have surgery.

Judge Pamela Chen ruled on Tuesday that Grimm could push back the start of his eight-month prison sentence for tax fraud from Sept. 10 to Sept. 22 so he could have an operation, which his lawyer requested last week.

The nature of the procedure wasn't specified in court papers.

In legal filings, Grimm's lawyers wrote that the earliest available appointment for the surgery was Sep. 9 — a day before he was scheduled to turn himself in to begin his sentence — and the procedure would require a brief healing period and a second appointment to have stitches removed.

In July, Grimm was sentenced to eight months in prison with a year's probation and 200 hours of community service for his tax fraud conviction for underreporting profits from an Upper East Side eatery he co-owned before he was elected to Congress.

He also agreed to pay back nearly $150,000 in restitution for the unpaid taxes.

Last year, Grimm pleaded guilty to tax fraud and resigned from his post on Jan. 5, which set off a special election for his seat that was won by former District Attorney Dan Donovan.
