PARK SLOPE — A series of photos allegedly capture "Heroes" actress Tawny Cypress' current husband serving up a super-sized beatdown on her former spouse outside a Brooklyn burger joint.
A lawyer for Cypress' ex, Bill Charles, said the photos — stills from a surveillance camera at Park Slope eatery Cheeburger Cheeburger — show Cypress' husband, Tom Dillon, clocking his client.
DNAinfo.com New York first reported Thursday that Charles, 58, was suing the TV star and Dillon, accusing them of luring him to the burger joint on June 6 in order to attack him and have him jailed.
The 11 photos provided to DNAinfo by Charles' lawyer, Robert J. Feldman, allegedly show his client exiting Cheeburger Cheeburger toward Dillon, who appears to be holding an object behind his back. Feldman said the photos show Dillon swinging at Charles, who then falls to the ground and lies unconscious.
The photos also allegedly show men restraining Dillon after the incident as Charles slowly gets back on his feet.
The lawsuit accuses Cypress, 36, of using the 12-year-old son she has with Charles to bait him into going to Cheeburger Cheeburger, where Dillon allegedly punched him. Another photo provided by Feldman allegedly shows the nose fracture and gash Charles suffered.
The lawsuit also accuses Cypress and Dillon of fabricating a version of events that made Charles look like the villain and led cops to arrest him.
Cypress' agent did not return a call for comment. The actress, whose character starred in the first season of NBC's sci-fi drama "Heroes," told the New York Post that the lawsuit was a lie.
"I hate this,” she told the newspaper. “The lawsuit is totally without merit; it’s completely without merit."
Charles spent six days in jail and was charged with four misdemeanors, including assault with intent to cause physical injuries and acting in a manner injurious to a child. He was released on his own recognizance, and his next court date is Jan. 23.
"The relatively minor charges against my client are merely a distraction of the serious charges of attempted murder and kidnapping that Thomas Dillon committed against my client," Feldman, Charles' lawyer, said. "[Dillon] concocted this whole thing. He had his cabal call police first."
The lawyer added that Charles abided by the court-ordered visitation rights he has with his child when he went to Cheeburger Cheeburger.
Charles, a photo agent who represents fashion photographers and photojournalists, declined to discuss details of the incident.
"The truth is in the filing," he told DNAinfo.com New York. "It's all there, as sad as it is."
Cypress has had roles on the TV shows "Rescue Me," "K-Ville" and "The Good Wife."
In December, her Facebook fan page said she was filming an episode of the modernized Sherlock Holmes show "Elementary."
