MANHATTAN SUPREME COURT — The brother of rapper Foxy Brown was indicted Friday on charges he scammed Hermès on Madison Avenue out of $8,000 using phony credit cards.

Gavin Marchand, 35, and three others face identity theft, criminal possession of a forged instrument and other charges for allegedly using real credit card account numbers on fake credit cards to make purchases at the posh boutique, according to prosecutors.

Police found phony IDs and credit cards stashed in the trunk of the getaway car that Marchand allegedly fled in Aug. 7 with his co-defendants, Warren David, 31, Derwin Benoit, 34, and Ryan Campbell, 32.

Benoit, the driver, allegedly sped away from the Upper East Side boutique at 90 miles an hour while running red lights through Manhattan.

Marchand's famous sister, Foxy Brown, whose birth name is Inga Marchand, is also facing criminal charges in another incident for allegedly violating a restraining order to stay away from a neighbor in Brooklyn.

Prosecutors announced that Marchand, who is free on bail, was indicted by a grand jury at a court appearance Friday.
