H&H Bagels Boss Gets 50 Weekends in Jail for Tax Scam

LOWER MANHATTAN — One of the city's top bagel-makers will be serving jail time instead of breakfast every weekend for the next year as part of a plea agreement in State Supreme Court.

H&H Bagels owner Helmer Toro will begin his weekends-only jail sentence on Friday and will return every week for 50 weeks, a punishment he agreed to when he pleaded guilty to grand larceny and other charges.

Toro, 59, admitted to pocketing employment taxes for over 100 employees by filing withholding taxes for them through  companies he created for the purpose of committing tax fraud, the DA said.

But instead of filing the taxes, he kept nearly $370,000.

In addition to the flagship store at Broadway and 80th Street, Toro also runs a wholesale store in Midtown West.

Toro, who faced up to 15 years in prison, also agreed to pay over $300,000 in restitution.
