MANHATTAN — A Trader Joe's customer is suing the supermarket chain after a falling shopping cart struck and injured her while she was riding an escalator at the store's Upper West Side outpost, a lawsuit says.

West Harlem resident Jeanette Myers was on the escalator in the store at 2073 Broadway on Oct. 28 when the falling shopping cart hit her, says the suit filed in Manhattan Supreme Court Wednesday. 

Myers blamed the store and its employees' negligence for her "serious and permanent injuries," accusing Trader Joe's of knowing about, and even creating, the "defective condition," the suit says. 

Myers is seeking more than $5,000 in damages to cover medical costs and loss of income, according to the suit.

Her lawyer could not be reached Wednesday to discuss the accusations in more detail.

A Trader Joe's spokeswoman said the company does not comment on pending litigation.
