Charges Upgraded to Manslaughter in Fatal Bronx Beating, DA Says

THE BRONX — Three people have been indicted on manslaughter charges for allegedly beating a man to death outside of a Bronx restaurant after he shoved a woman, officials said.

Donnell Soto, 36, was arguing with 22-year-old Jenny Gutierrez outside of the Parrilla Latina restaurant at 5523 Broadway on Oct. 2 around 4:15 a.m. and pushed her, at which point a group of people attacked him, officials said.

Hector Quezada, 23, is accused of knocking Soto to the ground by punching him in the head, after which Gutierrez, 23-year-old Joel Hernandez and others began repeatedly punching and kicking him, officials said.

Bronx District Attorney Darcel Clark described the attack in a statement as "street justice at its most brutal."

Soto was taken to St. Barnabas Hospital after the beating and died from his injuries on Oct. 12, and his death has been ruled a homicide, according to the NYPD.

Quezada, Hernandez and Gutierrez had previously been charged with gang assault in the attack, but the charges against all of them have since been upgraded to manslaughter, according to the Bronx District Attorney's Office.

They are still being charged with first and second degree gang assault as well, officials said.

Hernandez and Gutierrez were arraigned on Tuesday and had bail set at $100,000, while Quezada was arraigned on Wednesday and had bail set at $50,000, according to the Bronx DA's Office. All three are due back in court on Jan. 23.

Three other suspects wanted in the attack are still at large, officials said.
