UPPER EAST SIDE — Declan Garrity, the Barclays analyst charged with torturing his roommate's cat, was re-arrested Tuesday afternoon for violating a court order of protection, police officials said.

Garrity was originally arrested Feb. 24 after his roommate, Danielle, found her cat had suffered multiple injuries. He was charged with aggravated cruelty to animals as well as torturing and injuring animals and released on $5,000 bond.

A court order prohibited Garrity from going to his Second Avenue apartment where the alleged animal abuse took place. However, a judge permitted him to visit the apartment between 1 and 3 p.m. to retrieve his belongings as long as he was accompanied by a police escort, law enforcement sources said.

But when Garrity arrived at the apartment Tuesday afternoon, he was alone.

He greeted movers who were waiting on the street and rang the apartment's buzzer to be let in. A voice on the other end of the intercom asked, "Do you have police with you?"

"No," Garrity replied. "The movers are here."

The father of Danielle, Garrity's former roommate and owner of the cat he's accused of abusing, was waiting in the apartment, sources said. The father called his daughter to tell her Garrity had arrived without a police escort, and Danielle then called the police to report the violation of the court order.

Thirty minutes later a squad car arrived and two uniformed police officers entered the building.

At 2:45 p.m. police led Garrity out of the building in handcuffs and took him away in the back of the police car.

He was charged with criminal contempt in the first degree, according to police sources.

Danielle's father, who preferred not to give his name, told DNAinfo that he hadn't allowed Garrity to enter the apartment.

Garrity declined to comment on the charges against him. A call to his lawyer for comment was not immediately returned.
