
GREENWICH VILLAGE - The parents of actress Marisa Tomei are suing their next-door neighbor Sean Lennon, John Lennon's son, for $10 million over his roots.
Addie and Gary Tomei, who live at 155 West 13th St., say a decades-old Tree of Heaven (Ailanthus altissima) on Lennon’s property is cracking their stoop and uprooting part of their home’s foundation, according to a lawsuit filed in Manhattan Supreme Court on Monday.
“It’s a worsening situation,” Gerard Walters, a lawyer representing the couple said. “They’ve been talking about this for at least a year…[But Lennon] doesn’t want to take down the tree.”
The controversial tree is an invasive Chinese species and has a notoriously foul odor. Walters also said part of the tree's trunk is hollowed out.
Lennon’s lawyer Jonas Herbsman could not be reached for comment.
