Driver Won't Be Charged in Murray Hill Sidewalk Accident, Police Say

MURRAY HILL — The driver of a truck that swerved onto a sidewalk Thursday, striking a postal worker and nearly hitting two small children will not be charged with a crime, police said.

After an investigation, officials determined that the accident was caused by the truck’s defective brakes.

The accident unfolded around 3:20 p.m. near the corner of East 30th Street and Third Avenue, the Daily News reported.

The truck jumped the curb, crashed into a tree and took out a Muni-Meter. At the time, Debra Dermack and her two small children were walking down the street.

Dermack pushed her kids, ages 2 and 10 months, out of the way just in time to avoid the truck, which struck a postal worker before veering back out onto Third Avenue and colliding with a van.

"It happened so quickly," Dermack told the News on Thursday.

The unidentified postal worker suffered minor injuries, as did Dermack, who was hit by the falling tree. Both were treated at NYU Langone Medical Center.

Dermack did not return a call seeking comment.
