Australian Sheep Farmer Cleared Of Manhattan Rape Accusation

MANHATTAN - A Manhattan jury found an Australian farmer not guilty Friday of a rape he was accused of committing at Midtown's Affinia Hotel five years ago, the New York Post reported.

The jury refused to buy his accuser's claim that she was drugged by sheep and cattle farmer David Green, now 29, the Post reported.

"I'm over the moon," Green told the Post as he left Manhattan Criminal Court Wednesday, after spending almost a year and a half in jail. "I want a steak and a beer."

Green was cleared after defense lawyers showed at trial that urine taken from accuser Elizabeth Roarke five hours after the alleged attack showed no sign of drugs.

She claimed Green had spiked her beer with drugs, according to the Post.

The jury also discovered that Roarke had extensively used alcohol, ecstacy pot and cocaine in the past, and had had seven drinks that night, according to the Post.

Green initially skipped bail when he was arrested five years ago and returned to his family's Australian ranch. He was extradited back to the States after being caught trying to renew a passport in Sept. of 2009, the Post reported.

Green plans on filing a lawsuit agains Long Beach resident Roarke, defense lawyer Ronald Fischetti told the Post.

"The time has stopped for women to make false claims of rape and then walk away without any deterrent," Fischetti told the Post.

Green will be sentenced next month on charges of felony reckless endangerment for throwing beer bottles off of the roof of the same Affinia Hotel, a crime he admits to committing.
