MANHATTAN — An NYPD sergeant has been arrested for violating a restraining order issued against him by his wife, police said.
Eduardo Nieves, 47, was taken into custody Tuesday about 2:45 p.m. on charges of criminal contempt, police said Wednesday.
The order of protection against Nieves was issued after he punched his 28-year-old wife on Feb. 21, 2011, court records show. The couple fought over their son, who was 3-years-old at the time, records show.
He was arrested the following day, and later charged with assault, attempted assault, criminal mischief, official misconduct and unlawful imprisonment.
The order of protection was issued on Nov. 11, 2011. But Nieves, who works for the 84th Precinct in Brooklyn Heights, went on vacation with his wife, their son and some of her other children earlier this month — a violation of the court order.
He was arraigned Tuesday and released on his own recognizance.
A lawyer for Nieves could not immediately be reached for comment.
His next court date is on May 31.
