MIDTOWN — A tourist who tried using the bathroom at a McDonald's blocks away from the Times Square ball drop early New Year’s Day was attacked by a security guard angry that he refused to pay $5 to use the bathroom, police said.

The 21-year-old Georgia resident told police he was trying to use the restroom inside the McDonald’s at 1651 Broadway near 51st Street around 3 a.m. on Jan. 1 when he got into an argument with a security guard posted at the bathroom door, according to police.

After the man refused to pay and tried to get into the bathroom, the guard pushed him and hit him on the head with an unknown “metal-like” object, lacerating his neck and head, the man told police at the Midtown North precinct.

No arrest has been made and the case is under investigation.

The guard, who police said worked for the WSC Security Company, which was contracted to provide security at the site, was not named and could not be reached for comment.

WSC Security Company and a spokesperson for McDonald's did not immediately respond to requests for comment.
