CHELSEA — Former Knick J.R. Smith choked a 19-year-old who insulted him during an early morning argument outside 10ak, police said.

The 19-year-old victim asked for a picture with the Cleveland Cavaliers shooting guard around 4:00 a.m. near the corner of Tenth Ave. and West 17th Street, near the glitzy nightclub 1Oak on Nov. 13, according to police. 

Smith refused the fan's request, upsetting the 19-year-old who goaded the player with a snide comment about being traded to Cleveland in January.

"That's why you got kicked out of New York," the victim said to Smith, who then grabbed the 19-year-old by the neck, according to police.

The victim reported the incident two days later and did not have any visible injuries at the time, police said.

He didn't lose consciousness during the attack, police said.

As of Friday afternoon Smith had not been arrested or charged with the incident, police said.

"The allegation is completely false," said Smith's lawyer, Alex Spiro.
