Couple Caught Having Sex in Kips Bay Apartment Building Stairwell: Police

KIPS BAY — Officers interrupted a pair in the middle of a lewd act in the stairwell of a public housing building on East 28th Street, according to the NYPD.

A 41-year-old woman and a 29-year-old man were caught having sex inside of a building in the Strauss Houses at 344 E. 28th St. roughly 9:40 p.m. on Oct. 28, police said.

Neither of them live in the building and both were charged with trespassing as well as public lewdness.

The man was slapped with an additional resisting arrest charge for flailing and kicking at officers during his apprehension, according to police.

The pair were given summonses. It was not immediately clear if either had secured an attorney, or when they are due back in court.
