MANHATTAN — A Wall Street financial worker is accusing police of sodomizing him with a baton after they burst into his Bronx apartment, according to the New York Daily News.

In a Manhattan Federal Court civil suit, Ralph Johnson, 40, recently testified that the NYPD brutalized him and then tried to cover it up after responding to a domestic violence dispute in 2004, the News reported.

"They were kicking and punching me," Johnson testified, according to the paper.

Johnson's lawyers introduced into evidence a pair of his jeans with a hole torn in the bottom and lab test results that show his DNA was found on the skinny police baton, according to the Associated Press.

A doctor who examined Johnson after the police encounter said that abrasions and blood were "consistent with what he said happened to him," the AP reported.

City attorney Sumit Sud, however, said that Johnson's internal injuries were too minor to assume sodomy, and that the hole in his jeans was misleading, according to AP.

Police spokesman Paul Browne also told the News that the NYPD Internal Affairs Bureau found Johnson's allegation unfounded, and that the Bronx DA declined to prosecute.

The arrest occurred on Aug. 27, 2004, after neighbors called 911 when Johnson locked girlfriend Alison Bongo out of their apartment. Officers said the baton was used to apply handcuffs, the News reported.

During a taped interview, Johnson said he didn't know how he became injured, but later recanted his statement, saying that he was intimidated, according to reports.

Johnson is looking for damages from the city and the NYPD from his trial. The amount he is seeking in damages is unspecified.
