YORKVILLE — Health inspectors shut down a new deli on Third Avenue after finding mice and flies inside the eatery last week, records show.

Fillmore Delicatessen, which opened at 1668 Third Ave. in April this year, was shuttered by the Health Department after inspectors found mice and filth flies during a Dec. 8 inspection, according to the agency's records.

It was allowed to reopen on Monday after passing a re-inspection, according to Carolina Rodriguez, a spokeswoman for the health department.

The deli — which serves a slew of breakfast foods, sandwiches and burgers — was slapped with 33 violation points, including one for failing to vermin-proof the place.

"The Fillmore Delicatessen was temporarily closed on December 8th for critical health hazards that could not be corrected during the inspection," Rodriguez said.

During an April inspection, the deli was hit with 53 violation points for keeping food at an unacceptable temperature and for storing sanitized equipment or utensils incorrectly, records show. It wasn't closed at that time because the violations weren't considered a public health hazard, according to Rodriguez.

The manager of the deli said he could not immediately comment on Tuesday.
