Man Who Killed Wife's Would-Be Rapist Released on Assault Charges

MORRISANIA — The man who fatally beat his wife's would-be rapist on Monday was released without bail and had his charges downgraded from manslaughter to assault after being arraigned on Tuesday night, according to court documents and the Bronx District Attorney's Office.

Mamadou Diallo is accused of attacking 43-year-old Earl Nash, an ex-con who pushed his way into Diallo's apartment at 1240 Washington Ave. on Monday night and attempted to rape his wife Nenegale Diallo, police said.

Nenegale and her sister were able to fend Nash off and call her husband, who returned to the apartment and beat Nash with a tire iron several times, killing him, according to police and the criminal complaint.

Diallo was initially arrested for manslaughter, but his charges were later downgraded to assault, harassment and criminal possession of a weapon, according to police and court documents.
