Pickpocket Kicks Out NYPD Car Window During Arrest, Police Say

By Noah Hurowitz | October 7, 2015 2:20pm

CHELSEA — A pickpocket kicked out the window of a police car after officers arrested him and an accomplice for snatching another man's phone, according to police and prosecutors.

Daniel Maldonado, 25, bumped into the victim outside 333 Seventh Ave. and snatched his phone in the process before handing the device off to his accomplice, Spencer Daly, 28, at about 3:35 p.m. on Sept. 29, according to a criminal complaint from the Manhattan District Attorney's office.

The victim notified police of the theft and officers stopped Maldonado and Daly nearby. Daly tried to ditch the phone as police approached, according to the complaint.

When officers searched the pair, they also found a backpack belonging to a second victim, according to court documents.

As officers brought Maldonado to a squad car he allegedly began kicking, screaming and twisting his body, police said. Once they got him into the car, Maldonado kicked out one of the vehicle’s windows, according to police.

Both men were charged with grand larceny and possession of stolen property, according to court records. Maldonado was slapped with additional resisting arrest and criminal mischief charges, records show.

Maldonado was held on $1,500 bail and Daly on $1,000 bail, and they're due back in court on Oct. 25 and Oct. 28 respectively.

Attorneys for the men did not immediately return requests for comment.
