HELL'S KITCHEN — A man caught smoking a marijuana cigar on 10th Avenue swallowed it when he realized a police officer had spotted him with the drug, the NYPD said.

Dejon Smith, 22, was smoking the pot cigar at the northwest corner of 10th Avenue and West 39th Street about 11:40 p.m. Saturday, police said.

When an officer approached Smith, he swallowed the cigar in the hope it wouldn't be discovered, the NYPD said.

It was all for naught, though, as the officer discovered Smith also had an open 375ml bottle of Georgi vodka, police said.

The officer did not recover the cigar from Smith's body, according to a criminal complaint.

Smith was arrested and charged with tampering with physical evidence and obstructing governmental administration, prosecutors said. He had three other active warrants for his arrest at the time, officials added.

A lawyer for Smith could not immediately be reached for comment.
