STATEN ISLAND — A man died in front of his nephews Sunday night when a drunk driver slammed into him with his SUV, according to police and a report.

James Benedict, 67, was walking with some nephews in a bicycle lane on Lily Pond Avenue when a 2004 Lexus SUV hit him from behind about 6:55 p.m. near Guilford Street, according to the NYPD and the Staten Island Advance.

Benedict was rushed to Staten Island University Hospital and pronoucned dead, the NYPD said.

The driver, 39-year-old Michael Pogorzelski, was taken into custody at the scene and faced charges of driving while intoxicated, police said.

His nephews weren't hurt, the Advance reported.
