Mother Accuses Upper East Side Couple of Adopting Baby Without Permission

MANHATTAN — A woman who claims that an Upper East Side couple misrepresented their plan to adopt her daughter is suing to regain custody of the 13-month-old baby, the New York Post reported.

Vilma Ramirez, of Long Island, said she had just begun the process of putting her daughter Esperanza up for adoption with Andrew and Kelley Grant when they took custody of her. Ramirez claims the Upper East Side couple did so during the 45-day window where she was allowed to change her mind, the Post reported.

Ramirez gave up legal guardianship of her daughter Dec. 23, 2010, the Post reported. However, the terms of the agreement stated that Ramirez had 45 days to change her mind, at which point a judge would decide what was best for the baby, according to the paper.

"If I had been advised that ... the Grants could decide that I would never see Esperanza again, I would never have signed any consent or other documents," Ramirez told the Post.

The Grants, who live on East 83rd Street, said through their lawyer that there was no wrongdoing in the process and that the baby was cared for by others from the moment she was born, the Post reported.

The case is now being heard at Manhattan Surrogate Court.
