LOWER EAST SIDE — A local clothing designer claiming he owns the rights to the "Lower East Side" name is suing a second high-profile retailer for trademark infringement.
After filing a lawsuit against J. Crew in January for emblazoning the neighborhood name on its wares, Clinton Street resident Robert G. Lopez is now going after popular teen brand Aéropostale for using the "Lower East Side" logo, Bowery Boogie reported.
Lopez claims in his suit that he has ben selling T-shirts, sweatshirts and other merchandise with the "Lower East Side" name since 1997, and that he registered it as a trademark in 2007.
He added in the suit that Aéropostale began selling clothing using the name in late 2010, and that he is seeking all profits derived from the company's sale of products bearing the name, as well as undetermined damages.
Representatives for Aéropostale did not immediately return a request for comment.
