For the next 90 days, the city will work with homeowners to get their elevators into compliance.

Pat Comunale, the victim's father, filed the suit against Jeffrey Rackover on Sunday.

The city has been planning the park's design since 2013.

City Planning commissioners said the rezoning plan could discourage the creation of affordable housing.

The plans were initially rejected in January.

The elevator was installed in the 1940s but had not been registered with the city, officials said.

The elevator fell to the basement of 19 Sutton Place on Wednesday afternoon. 

The group submitted its proposal for certification so it can go through the public review process.
