3 Rikers Correction Officers Get Probation for Covering Up Inmate Beating

THE BRONX — Three former correction officers were sentenced to five years of probation on Thursday for covering up the brutal beating of an inmate after Superstorm Sandy.

Captain Moises Simancas, 40, Correction Officer April Jackson, 36, and Correction Officer Tyrone Wint, 31, had pleaded guilty to falsifying business records after submitting false Use of Force reports following the Oct. 30, 2012 beating of inmate Gabino Genao.

Genao had shouted at one of the officers for being confined to his cell for longer than usual following the devastating storm, after which all three of them pulled him into a stairwell out of view from the other guards and beat him into unconsciousness with their batons.

The guards submitted a false report about the incident, but investigators then found that Genao's injuries were consistent with being beaten by a DOC-issued baton.

Judge Martin Marcus handed down the sentences on Thursday afternoon and said that the officers had disgraced their profession with their actions.

"It was a foolish and cowardly act," he said. "You'll have to live with the consequences of your actions for the rest of your lives."

The guards all officially resigned from their jobs in November.

Bronx District Attorney Darcel Clark said in a statement that "Correction Officers must realize that they will pay a steep price if they cover up brutality or corruption on Rikers Island.”
