Man Accused of Raping 7-Year-Old Held Without Bail, Prosecutors Say

STATEN ISLAND — The man accused of breaking into a Staten Island home and raping a 7-year-old girl in her bedroom pleaded not guilty to the charges and was held without bail at his arraignment on Friday, prosecutors said.

On Aug. 6, police said Daniel Nieto, 32, broke into the home through a backdoor at about 2:45 a.m., entered the girl's bedroom, sexually assaulted her then fled the house, police said.

He was arrested on Aug. 18 in East Brunswick, N.J.

Nieto was hit with an 11-count indictment at his arraignment and charged with rape, committing a criminal sexual act, sexual abuse, assault and endangering the welfare of a child, the Staten Island District Attorney's office said.

He's due back in court on Sept. 28, according to online court records. His lawyer did not respond to request for comment.

He was previously arrested for criminal possession of marijuana, police said.
