MIDTOWN — He's got 99 problems but a permit ain't one.
Hip-hop icon Jay-Z won approval this week to perform atop the Ed Sullivan Theater marquee next month, part of an appearance for the "Late Show with David Letterman" that will close streets around the theater during rush hour, the New York Post reported.
Jay-Z, whose real name is Shawn Carter, applied to take his Empire State of Mind to the top of the marquee July 8 when he's scheduled to appear on the "Late Show." He got approval for the concert this week.
Police will close Broadway between 53rd and 54th streets for the show.
The mayor's office had previously rejected a similar request from Jay-Z and Eminem in June 2010, citing security and crowd-control concerns. The pair moved that performance from the marquee to the theater's roof, which did not require them to get an additional permit.
Next month's show will mark the third time in 10 years a band has performed atop the Ed Sullivan marquee: Phish serenaded fans from there in 2004, and Paul McCartney played from there in 2009.
The mayor's office did not immediately return a call and email Friday morning.
