Mom's Boyfriend Charged with Murder in Death of 5-Month-Old Bronx Boy

THE BRONX — The death of a 5-month-old baby boy who was found unresponsive in a Soundview apartment in February was ruled a homicide Thursday, and his mother's boyfriend was charged with murder, officials said.

Jacob Agusto died of "abusive head trauma," the Chief Medical Examiner's office said, after the child was found in his family's apartment at 619 Beach Ave. on Feb. 14 alone with 46-year-old JW Hicks, Agusto's mother's boyfriend.

Hicks was arrested Thursday and charged with murder and manslaughter, the Bronx District Attorney's Office and the NYPD said.

Hicks was initially arrested back in February after allegedly taking a swing at a police officer questioning him about the baby's death. He was charged then with resisting arrest and attempted assault.

He had prior arrests for robbery and weapons possession as well.

Agusto's mother was out running errands when the baby died.
