CLASON POINT — A Bronx man was under arrest Thursday morning after taking a swing at police when they tried to question him over the death of his girlfriend's 5-month-old baby, police sources said.

Baby Jacob Agusto was pronounced dead at Jacobi Medical Center about 2 p.m. Wednesday after suffering injuries that appeared to be consistent with shaken baby syndrome, law enforcement sources said.

Jacob's 24-year-old mother had left him with her 46-year-old boyfriend — whose identity was not immediately released — at their home at 619 Beach Ave. while she ran errands, police said. The mother arrived home to find Jacob distressed and lying on a bed not breathing, NYPD and sources said.

The Medical Examiner will determine Jacob's cause of death, but sources said the child's injuries  indicated that he was shaken excessively.

No arrests have been made in connection with Jacob's death, but the boyfriend, who isn't the child's father, was being questioned in the 43rd Precinct stationhouse. He had changed his story multiple times, sources said.

At one point, sources said the boyfriend offered up a story that police didn't believe. When they challenged him, he allegedly tried to slug one of them and was arrested for assaulting an officer.

The boyfriend was arrested previously for robbery and weapons possession.

The Administration for Children's Services was investigating Jacob's death Thursday, a spokesman said.
