MANHATTAN — A restaurant worker's claims that he was hit by a car driven by Lindsay Lohan are being questioned by police, who have studied surveillance video of the incident.
The recording, taken by a camera at a Chelsea hotel where Lohan partied early Wednesday captured the incident, but it proved inconclusive, police sources said.
The surveillance doesn't conclusively show Rodriguez being struck by Lohan's black Porsche Cayenne SUV outside of the Dream Downtown hotel early Wednesday, the sources added.
Without confirmation, cops can't be sure that Rodriguez, who works for Maritime Hotel's La Bottega restaurant, is telling the truth about the hit-and-run, sources said.
Rodriguez, who lives in Jersey City, complained of a knee injury and was taken to Bellevue Hospital.
Lohan was arrested at 2:30 a.m. and charged with leaving the scene of an accident. The NYPD said it did not suspect any other criminality, such as driving on drugs or alcohol.
Police sources said the video shows Rodriguez chasing the SUV down after it allegedly hit him.
"While some of the facts are still being gathered, it appears this is much ado about nothing," said Steve Honig, Lohan's rep. "We are confident this matter will be cleared up in the coming weeks and the claims made against Lindsay will be proven untrue."
Lohan was given a desk appearance ticket at the 10th Precinct stationhouse in Chelsea and released.
On Wednesday, Lohan retweeted a fan's post, which read: “The world really should stop picking [on Lindsay Lohan].”
An NYPD spokesman said an investigation into the incident was ongoing and that the surveillance video could be released by the end of the week.
The alleged hit-and-run is the "Mean Girls" actress' latest run-in with the law.
Lohan's legal troubles include a 2007 driving under the influence conviction, a probation violation and a conviction for stealing jewelry.
