Red Sox Slugger David Ortiz Offers to Settle Jay-Z's 40/40 Suit

MANHATTAN — Boston Red Sox star David Ortiz finally sent a lawyer to deal with claims he named his Dominican Republic nightspot after Jay-Z's chain of 40/40 clubs.

Jay-Z's $5 million trademark suit accuses "Big Papi" of naming his Santo Domingo club "Forty-Forty" to trade in on the success of the rap star's chain of clubs, the New York Post reported. The suit also extends to a promotional website for the club.

"My client offered to take down the allegedly infringing website, and we're going to talk about the name of the Dominican Republic club," said Philip Touitou, the lawyer representing Ortiz, the Post reported.

Speaking at Manhattan Federal Court, Judge Richard Berman encouraged both sides to "save time and money," by settling out of court according to the Post.

The name of the club chain is a baseball reference to hitting 40 home runs and stealing 40 bases in one season.
