This sweepstakes (the "Promotion") is only open to legal residents who are physically located in one (1) of the fifty (50) United States and District of Columbia who are at least eighteen (18) years old as of the date of entry, except officers, directors, members, employees of the Sponsor and the immediate family (i.e., parents, children, siblings, spouse) of these individuals. This Promotion is void outside the fifty (50) United States and the District of Columbia, and where prohibited by law.

To enter, visit www.dnainfo.com/sweepstake/david-burke-gift-card during May 15th, 2012 – July 1st, 2012 (the "Promotion Period") and follow the instructions to complete and submit the entry form. All entries become the property of the Sponsor and will not be acknowledged or returned. Limit: One (1) entry per person and per e-mail address during the Promotion Period. Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact information or otherwise may be disqualified. All entrant information, including e-mail addresses, is subject to the respective Privacy Policy of the Sponsor.

  6. Drawing will be held on/around July 2nd, 2012. One (1) winner will be drawn for a one-hundred (100) dollar gift card to David Burke Restaurants, redeemable at David Burke Townhouse (NYC), David Burke at Bloomingdale's (NYC), Fishtail by David Burke (NYC), David Burke Kitchen (NYC), David Burke Treehouse (NYC), David Burke Garden (NYC), David Burke's Primehouse (Chicago), David Burke Fromagerie (Rumson, NJ), and David Burke Prime (Connecticut).The odds of winning depend on the number of eligible entries received. All prizes will be awarded. No cash value.
  7. Winner will be notified via email. Winner must comply with the instructions contained in the prize notification letter, and may be required to sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (where permitted by law), within fourteen (14) Business Days of the date on the prize notification letter or prize will be forfeited and an alternate winner chosen. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner. In the event of a dispute concerning the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered.
  8. Entries that are lost, late, misdirected, garbled or incompletely received, for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion or incompatibility at Sponsor or elsewhere, will not be eligible and Sponsor is not responsible for any technical problems related to online entries. Sponsor reserves the right to modify, suspend or terminate this Sweepstakes in the event that it becomes infected by a computer virus or is otherwise technically impaired. In the event of termination, a random drawing will be held from among all eligible entries received at the time of termination.
  9. All federal, state and/or local income and other taxes, if any, are the winner's sole responsibility. The winner may be required to provide Sponsor with a valid social security number or tax identification number before the prize will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of winner.
  10. Acceptance of prize constitutes consent to use winner's name and likeness for editorial, advertising and publicity purposes, without further compensation, except where prohibited. By entering and/or by accepting a prize, you agree to be bound by these rules and to release Sponsor and the Prize Contributor from any and all liability arising out of your participation in this Sweepstakes with respect to the awarding, receipt, use and/or misuse of any prize. By entering and/or by accepting the prize, you agree to have your name listed as the winner on www.dnainfo.com, and in the www.dnainfo.com, free e-mail newsletter and on Participating Contributor's website.
  11. No substitution of prizes, except by Sponsor or Prize Contributor in which case a prize of greater or equal value will be substituted. Prizes are not transferable.

Entrants agree that they shall not upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
  13. Sponsor reserves the right to modify, suspend, disqualify or terminate any entrant in the event that an entry become infected or is otherwise technically impaired. Sponsor also reserves the right to disqualify any entrant found tampering with the entry process or with the operation of the Giveaway or the web site.
  14. All entries become the property of Sponsor and will not be acknowledged or returned.
  15. This Sweepstakes is governed by the laws of the United States with venue in New York County in the State of New York.
