Man Survives When Gun Pointed at Head Malfunctions, Police Say

PORT RICHMOND — A deli argument turned bloody when a man tried to shoot another in the head, but ended up shooting him in the leg after his gun failed, prosecutors said.

John Hines, 23, was arrested on Tuesday for the Sept. 6 shooting in front of a deli near the intersection of Henderson and Port Richmond avenues, prosecutors said.

Hines got into an argument with a 28-year-old man who walked into the store to buy beer at about 3:30 a.m., a law enforcement source said.

When the victim walked out, the two continued the argument and Hines pulled out a gun, pointed it at the victim's head and pulled the trigger. The gun didn't fire, the source said.

Hines tried to shoot again and hit the victim in the leg, prosecutors said.

The victim was taken to Richmond University Medical Center with serious injuries, prosecutors said.

Hines was arrested on Tuesday and charged with attempted murder, assault and criminal possession of a weapon at his arraignment, the Staten Island District Attorney's office said.

He was held on $150,000 bail and is due back in court on Sept. 24, according to court records.

Hines has been arrested several times before, including in 2013 for assault and last year for criminal possession of a weapon, according to court records.
