Mom Charged With Murder of 1-Year-Old Son in Midtown Burger Eatery: DA

MIDTOWN — The woman accused of killing her 1-year-old son in a Midtown restaurant this past spring was indicted on murder charges on Friday, the Manhattan District Attorney announced.

Latisha Fisher, 36, who had a history of domestic assault, strangled her son, Gavriel Ortiz-Fisher to death inside 5 Boro Burger at West 36th Street and Sixth Avenue on in the middle of the afternoon on March 30, according to prosecutors.

She had already been arraigned on strangulation charges in April. 

“Latisha Fisher is charged with deliberately killing her 20-month-old son, tragically ending the boy’s life,” District Attorney Cy Vance said in a statement. “Today, with this murder indictment, we are seeking justice for the senseless death of an innocent child.”

Restaurant staff discovered Fisher sitting in the bathroom holding her son, who had blue lips and was from foaming from the nose, according to the DA.

Gavriel was rushed to Bellevue Hospital where he was pronounced dead.

The mother stayed on the scene and allegedly told FDNY responders that the devil made her “put him to sleep.”

She then showed them how she smothered the boy cupping her hands and showing where she placed them over his face.

Gavriel she remained held without bail after her arraignment on second-degree murder charges in Manhattan Supreme Court on Friday.
