Man Strikes Off-Duty Officer With Car, Prosecutors Say

TOTTENVILLE — A man was charged with assault after he struck an off-duty NYPD officer driving a motorcycle on Wednesday because he made too much noise, a law enforcement source said.

Jeffrey Pernicka, 25, was driving a gold van on Page Avenue when he crossed the double yellow lines, accelerated and turned his vehicle quickly into the off-duty officer at the intersection of Hylan Boulevard at nearly 2:50 p.m., prosecutors said.

Pernicka then made a u-turn, drove away from the crash and hid inside his home on Hylan Boulevard, prosecutors said. He was later arrested, police said.

The officer was taken to Staten Island University Hospital South and treated for a broken rib and a separated shoulder, police and prosecutors said.

A source said Pernicka knew the victim was an officer and previously confronted him about making too much noise.

His lawyer, Yan Katsnelson, said Pernicka didn't intentionally hit the man or knew who he was.

"My client denies all allegations alleged in the complaint, especially that he knew the gentleman on the bike," Katsnelson said. "He had no idea that the gentleman was a cop."

This wasn't the first time Pernicka got arrested over somebody being loud.

He was arrested in November after he allegedly shot a crossbow into a car of his neighbor who he said was making too much noise, He then cried for his grandmother while being arrested.

He was charged with assault, attempted assault, reckless endangerment, leaving the scene of an incident without reporting and driving without a license for his latest arrest, according to the District Attorney's office.

Pernicka's bail was set at $100,000 bond, $25,000 cash, and he's due back in court on April 21, according to online court records.

Other notable crimes in Staten Island include:

► A man was arrested after prosecutors said he got into an accident riding a stolen motorcycle on Monday.

On Sunday, Christopher Pantaleo, 37, stole a 2006 Suzuki motorcycle parked in front of 570 Rathburn Ave., prosecutors said.

The next day, Pantaleo was driving the motorcycle when he crashed it into a Ford minivan in front of 121 Green Valley Road at nearly 11:45 p.m., prosecutors said. The accident damaged the rear bumped and windshield of the car.

Pantaleo fled the scene and was arrested on Tuesday at his Russek Drive home, where officer found drugs on him, prosecutors said.

He was charged with grand larceny, criminal possession of stolen property, petit larceny, criminal possession of a controlled substance, leaving the scene of an incident without reporting, and unauthorized use of a vehicle at his arraignment, according to the District Attorney's office.

Information for Pantaleo's lawyer was not immediately available.

► A man was arrested after he stole cash from a bodega and a car lot in Staten Island, prosecutors said.

Randy Jackson, 29, was arrested on Tuesday for taking cash from the A&C Suprette, at 886 Manor Road, in October and Crazy Joe's used car lot, at 685 Cary Ave., in June 2014, prosecutors said.

Jackson was charged with burglary, grand larceny, petit larceny, criminal mischief and criminal possession of stolen property for both cases, according to the District Attorney's office.

He was given $10,000 bail for both cases, and is due back in court on April 28, according to online court records.

Jackson's lawyer could not be reached for comment.

► Two men punched a woman on a Stapleton street and stole her cellphone, makeup and cash from her purse, prosecutors said.

Oscar Hernandez, 29, and Edward Avandanvo, 35, approached the victim on Tuesday at the corner of Canal and Bay streets at nearly 3:20 a.m. They grabbed her arms, punched her body, then took her LG cellphone, lipstick, nail polish, eye makeup and $60 in cash from her purse, prosecutors said.

The pair were arrested later that day.

They were charged with robbery, petit larceny, criminal possession of stolen property, attempted assault and harassment at their arraignment, according to the District Attorney's office.

Hernandez's bail was set at $1,000 and Avandavano was released without bail, according to online court records. Hernandez is due back in court on Friday, and Avandavano is due back in court on May 19.

Avandavano's lawyer could not be reached for comment. Hernandez's lawyer, Kevin McKernan, did not have a comment for the story.
