Judge Dismisses Case Against Surfer Who Punched Dog Owner

HELL'S KITCHEN — A judge dismissed the case against a surfer who slugged a dog owner in Hell’s Kitchen after stepping over his Chihuahua, the Manhattan District Attorney's Office said.

The case against Corey Pohan, 32, could not be proven beyond a reasonable doubt and was dropped Monday, the DA's office said.

The blond native New Jerseyan was caught on video slugging a stranger and running away in July.

According to neighbors at the scene of the fight, Pohan stepped over a chihuahua named Peanut belonging to Paul Martone, 49. The two argued and Pohan punched Martone, knocking him to the ground and fracturing his skull.  

Police sources said in July that Martone was "clearly the aggressor" in the incident. It was not clear if Martone would be charged.

Pohan fled the scene and was taken into custody in New Jersey that night at his mother's house, according to NJ.com.

But as the police car approached the Secaucus toll plaza on the New Jersey Turnpike, Pohan made a run for it, jumping out of the car and climbing on top of a tollbooth. State troopers found him there and arrested him for fleeing the scene and trespassing, DNAinfo reported in July.

Pohan pleaded guilty to the trespassing charge in a plea deal in July and received a 13-day sentence of time served and a $256 fine, NJ.com reported.

Neither Pohan nor his attorney could be reached for comment.
