Staten Island Man Kicks Landlord's Yorkie in Drunken Dispute, DA Says

WESTERLEIGH — A Staten Island man kicked his landlord's Yorkie so hard during a drunken argument he had to eventually be euthanized, prosecutors said. 

Nick Miller, 70, was charged with animal cruelty at his arraignment on Wednesday for kicking his 59-year-old landlord's Yorkie named Remy in the face and paws, prosecutors said.

Police arrested Miller on Tuesday on an unrelated charge of stealing a motorized scooter, worth $1,700, from the Pathmark at 1351 Forest Ave. and riding it out of the store, the Staten Island Advance first reported.

Miller, who has a long history of DUI arrests, was re-arrested after his former landlord filed charges for Remy's death, according to the Advance and prosecutors.

On June 26, during a dispute with his landlord at her Willow Road East home, Miller kicked Remy in the face and paws, court papers said.

After the kick, Remy's owner observed her pet shaking, howling, unable to eat and walk. Eventually Remy had to be taken to a local animal hospital and put to sleep, court papers said.

Remy's owner could not be reached for comment for this story.

Miller was charged with torturing and injuring an animal, and grand larceny, criminal possession of stolen property and petit larceny for the scooter incident. He's due back in court on Friday for both cases, according to court records.

His lawyer declined to comment.
