Lindsay Lohan Not Yet Charged in Alleged Club Assault

MANHATTAN SUPREME COURT — The Manhattan District Attorney will hold off on pressing charges against Lindsay Lohan for an alleged assault in a Chelsea club, according to court officials.

Cops arrested the "Liz & Dick" star after an early-morning scuffle in November, when she allegedly knocked Tiffany Eve Mitchell, 28, to the ground in the VIP section of Avenue, a club at 116 10th Ave.  

Because of the lack of charges, Lohan herself did not have to appear in court, but her lawyer, Mark Jay Heller, was there on her behalf.

Heller told dozens of reporters and photographers he was confident the district attorney would eventually decide not to press charges against Lohan, and he claimed to have brought forward a witness who saw that there was no altercation between the two women. He added that Mitchell, a psychic from Florida, was simply "seeking 15 minutes of fame."

"[Lohan] was relaxing, and she was rudely accosted by various individuals who were pursuing her to read her fortune and to take pictures of her. She politely asked to be left alone," Heller added.

"Apparently, this event arose when, not Lindsay, but the other individuals, became very aggressive."

Erin M. Duggan, a spokesman for the District Attorney's office, said the investigation into the allegations is continuing.

On the morning of the alleged incident, Mitchell was at the club with her husband, Wayne Stevens, and another couple, Lisa Mitchell and Steve Blake, 37, at a separate table from Lohan, according to sources.

After a different fight broke out near their table, Tiffany Mitchell backed away towards Lohan, sources said. According to sources, Lohan got angry, shoved her from behind and punched her in the face.

"Give me some space," Lohan told the victim, according to gossip website TMZ.

The psychic claimed the blow knocked her off her feet and caused her face to swell.

Heller disputed that charge, claiming Lohan was not aggressive throughout the incident.

"Lindsay Lohan was simply trying to have a little bit of peace and quiet," he said.

Heller said that Lohan would come to court if charges were eventually filed against her.

The incident is one of Lohan's many recent run-ins with the NYPD. In September, she was arrested for apparently hitting a man with her car and driving off outside a Chelsea club, but authorities later dropped those charges.

Later that month, Lohan told cops she was choked by a man after the two got into a row about photos that had been taken of her.

Heller said the celeb's luck may be looking up, however.

"A psychic fortune teller has predicted that the year 2013 will be a lucky year for Lindsay Lohan," he said.
