An accused rapist from Australia was extradited from his parents' farm and arraigned yesterday in Manhattan court. David Green, 28, faces charges he attacked a woman in a Madison Square hotel four years ago — but Green's lawyer says the sex was consensual and there are photos to prove it. [Daily News]

The case against a police office charged with driving under the influence and killing a preacher's daughter in Brooklyn is in jeopardy because officials waited seven hours after the crash to test his blood alcohol level. NYPD Officer Andrew Kelly's doctor reputedly didn't know he could test the officer's blood alcohol level without his consent. [Daily News]

The Ohio state attorney general is suing Bank of America in Manhattan federal court. Richard Cordray launched the class-action lawsuit on behalf of investors accusing bank executives of concealing their losses while awarding $3.6 billion in bonuses in 2008. The AG is also seeking damages from the bank's top executives. [NYTimes.com]
