Owner of Dog Killed by Electric Shock Files $250K Lawsuit

OLD TOWN — The man whose dog was killed by electric shock on an Old Town sidewalk in February filed a lawsuit Tuesday against the building owner, property manager, ComEd and other unknown parties, seeking at least $250,000 in damages. 

Brian Malone was out walking his dog in the 1400 block of North Sedgwick Street when the dog got too close to a puddle of water next to a fence in front of the Marshall Field Garden apartment and started spasming and yelping.

The dog died on the sidewalk after what appeared to be a series of seizures. Later, it was revealed that the dog died from electric shock. The cone he had bumped into was covering a copper grounding rod. 

Malone is seeking at least $250,000 in damages from building owner LR Development Company, LLC, property manager Metroplex, Inc., Commonwealth Edison Company and other unknown parties to cover the cost of medical bills, lost wages and psychological trauma, according to the lawsuit.

"The Defendants knew or should have known with substantial certainty that grounding a live electrical wire to a metal fence is substantially likely to cause severe harm to anyone that comes into contact with the fence," the suit reads. 

Prior to the fatal incident, Malone spent a lot of time caring for his dog, LaDainian, who had multiple health problems. He was diagnosed with severe bronchial pneumonia and underwent open-heart surgery. Malone's doctor identified LaDainian as an emotional support dog for Malone, according to the lawsuit. 

A spokesman for Metroplex, Inc. issued the following statement: "We have not been served with a complaint and do not comment on pending litigation."
