CHICAGO — A Cicero man has been charged with driving under the influence for fatally striking a 3-year-old boy with his car in Archer Heights in 2013, police said.

Around 10:20 p.m. July 20, 2013, Erick Ochoa, 24, was driving in the 3900 block of West 47th Street when a 3-year-old emerged from between two parked cars and was struck by Ochoa, police said.

The boy, identified as Jimmy Lomas, of suburban Bellwood, was taken to Advocate Christ Medical Center, where he was pronounced dead at 11:11 p.m., police said.

Ochoa was ticketed for the accident, and further investigation revealed he was under the influence of a controlled substance. He was picked up during a traffic stop on April 26 and is expected in bond court Tuesday.

He is charged with a felony count of aggravated DUI leading to a death, driving on a suspended license and failure to stop at a stop sign, police said.
