Mom Who Threw Baby in Hudson River Expected to Be Released on Bail

MANHATTAN SUPREME COURT — A woman charged with throwing her child into the Hudson River before apparently trying to drown herself is expected to be released on bail, a Manhattan judge said Friday.

Manhattan Supreme Court Judge Lewis Bart Stone said he intends to release the mother, Devi Silvia, 34, on $10,000 bail on the condition that she attends regular outpatient psychiatric treatment.

Silvia has been at Elmhurst Hospital, both as an inmate and in a civilian capacity, since she and her 19-month old child were recovered from the freezing waters on May 11.

"At this point I see little risk to the country or to her children by letting her out on the high likelihood that she'll return," Stone said.

The judge said that given several factors, including Silvia's claim of mental illness, he is not sure that she can be held criminally liable in the incident.

"I don't know whether at the end of the day it'd be [considered] criminal or not," Stone said.

Silvia must appear in court on Monday for final discussion on the matter.
